Terms of Service

0. Scope & acceptance

These Terms of Service (“Terms”) govern your access to and use of the FitMyGenes website, services, and digital genetic reports (collectively, the “Services”). These Terms apply to all users regardless of location.

You must explicitly accept these Terms prior to purchase or file upload by checkbox or an equivalent affirmative action. If you do not agree, do not use the Services.

1. Provider identity

The Services are provided by Optima Systems Oy (Business ID / Y-tunnus: 3347527-2), a Finnish legal entity. Registered address: Yliopistonkatu 14A18, 40100 Jyväskylä, Finland. Contact email: support@fitmygenes.com.

Services are provided from the EU.

2. Definitions

  • Company: Optima Systems Oy.
  • User: a person who accesses or uses the Services.
  • Services: the digital genetic analysis services, including file upload, automated processing, reports, website, APIs, and support.
  • Genetic Data: personal data relating to inherited or acquired genetic characteristics that provides unique information about a person’s physiology or health.
  • Raw Genetic File: a genetic data file uploaded by the User (for example, consumer genomics provider formats) used as input for the Services.
  • Derived Data: results produced from the Raw Genetic File, such as polygenic scores, percentiles, and the generated report output.
  • Report: an informational report generated by the Services based on the User’s uploaded Raw Genetic File and statistical models.
  • Website: the FitMyGenes website through which the Services are offered.

3. Description of the Services

The Services provide digital analysis of User-provided genetic data and generate informational reports based on statistical and population-level models.

Explicit exclusions

  • No medical diagnosis.
  • No clinical testing.
  • No therapeutic recommendations.

4. Eligibility

  • You must be at least 18 years old.
  • You must have legal authority to upload the genetic file.
  • You must upload your own genetic data or have explicit authorization to upload and process it.

5. User obligations

  • Provide accurate information necessary to deliver the Services.
  • Upload only files you own or are authorized to use.
  • Do not upload third-party genetic data without consent and authorization.
  • Do not misuse, reverse-engineer, attempt to manipulate, disrupt, or interfere with the Services.

6. Genetic data disclaimer

Reports are informational and educational only. Genetic results are probabilistic, not deterministic. Results may be incomplete or inaccurate. Reports do not constitute medical, diagnostic, or healthcare advice. You must not rely on a report for medical decisions. You are responsible for interpreting results.

7. No professional advice

The Services do not provide medical advice, health advice, nutritional advice, psychological advice, or sports or fitness advice. You should consult qualified professionals before acting on information from the Services.

8. Intellectual property

  • The Company owns all intellectual property rights in the Services, including algorithms, models, software, and report formats.
  • You retain ownership of your uploaded Raw Genetic File.
  • You receive a limited, non-transferable license to access your Report for your personal use.

9. Payment & pricing

  • Pricing is shown before purchase on the Website.
  • The Services are sold as a one-time purchase per report unless explicitly stated otherwise at checkout.
  • Payments are processed via our payment processor using the payment methods made available at checkout.
  • Taxes may apply where applicable and will be displayed at checkout where required.

10. Refunds & cancellations

The Services are digital. Refund eligibility depends on whether processing has begun:

  • If you request cancellation before processing begins, we will refund the amount paid for the applicable purchase.
  • No refunds once processing has begun.
  • If we cannot deliver the Report due to a technical failure attributable to us, we will either reprocess or refund the amount paid for the applicable purchase.
  • Refunds are subject to the payment processor’s rules and timelines.

11. Service availability & modifications

We do not guarantee uninterrupted availability of the Services. We may modify, discontinue, or update the Services, features, or Reports at any time.

12. Data handling reference

Our processing of personal data and genetic data is governed by our Privacy Policy. Genetic data handling is governed by the Privacy Policy.

13. Limitation of liability

To the fullest extent permitted by law, the Company will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services or any Report.

To the fullest extent permitted by law, the Company’s total liability for any claim arising out of or related to the Services will not exceed the amount paid by you for the applicable Report.

14. Indemnification

You agree to indemnify and hold harmless the Company from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

  • Unauthorized file uploads.
  • Misuse of the Services.
  • Violation of these Terms.

15. Assumption of risk

You assume all risks associated with use of the Services and any Report. Genetic analysis involves inherent uncertainty, and results may not reflect your individual outcomes.

16. Termination

We may suspend or terminate your access to the Services if you violate these Terms or misuse the Services. You may stop using the Services at any time.

If access is terminated, we may disable access to Reports or Services. You can request deletion of retained Derived Data as described in the Privacy Policy.

17. Governing law & jurisdiction

These Terms are governed by the laws of Finland, and this choice of law applies regardless of your location. Disputes arising out of or related to these Terms or the Services are subject to the courts of Finland.

18. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

19. Changes to the Terms

We may modify these Terms from time to time. The effective date above reflects the current version. If we make material changes, we will provide notice via the Website or by email where appropriate.
